Senate Joint Resolution No. 30 will be submitted to the voters of Oklahoma on November 2, 2004, as State Question 714. This question would amend Article X, Section 8C of the Oklahoma Constitution, which relates to "Limit on fair cash value on homestead."

The Attorney General has prepared a subsitute ballot title for this question: This measure amends the Oklahoma Constitution. It amends Section 8C of Article 10. This measure changes the method for determining the fair cash value of the homestead of certain heads of household. The change only applies to heads of household who meet two requirements. First, they must be at least 65 years old. Second, their gross household income must meet income level requirements. This measure changes the income level requirement. At present, to be eligible, the gross household income from all sources must be $25,000 or below. The amendment changes the qualifying income level. To be eligible under the change,gross household income cannot exceed the area's mean income levels. The agency determines mean income levels for counties and metropolitan areas. The State Tax Commission must inform each county of the extablished mean income levels each year. |
A Joint Resolution directing the Secretary of State to refer to the people for their approval or rejection a proposed amendment to Section 8C of Article X of the Oklahoma Constitution; establishing date after which new income limits apply; modifying income limits for determining fair cash value of certain homesteads; establishing method of determining income thresholds based on homestead location; providing ballot title; and directing filing. BE IT RESOLVED BY THE SENATE AND THE HOUSE OF REPRESENTATIVES OF THE 2ND SESSION OF THE 49TH OKLAHOMA LEGISLATURE: SECTION 3. The Secretary of State shall refer to the people for their approval or rejection, as and in the manner provided by law, the following proposed amendment to Section 8C of Article X of the Constitution of the State of Oklahoma to read as follows: Section 8C.
A. Despite any provision to the contrary, beginning January

The income threshold for the gross household income from all sources for an individual head of household under this section shall not exceed the amount determined by the United States Department of Housing and Urban Development to be the estimated median income for the preceding year for the county or metropolitan statistical area which includes such county. The Oklahoma Tax Commission shall provide such information to each county assessor each year as soon as such information becomes available. SECTION 3. The Ballot Title for the proposed Constitutional amendment as set forth in SECTION 1 of this resolution shall be in the following form: BALLOT TITLE
THE GIST OF THE PROPOSITION IS AS FOLLOWS: This measure amends the Oklahoma Constitution. It amends Section 8C of Article 10. This measure changes the way the fair cash value of a homestead is figured. It applies to individuals over 65 years of age. It changes the income limit for the head of household. The income limit would change from more than $25,000 to the estimated median income for each individual county or the metropolitan statistical area which includes the individual county. SHALL THIS AMENDMENT BE APPROVED BY THE PEOPLE? YES, FOR THE AMENDMENT NO, AGAINST THE AMENDMENT SECTION 3. The President Pro Tempore of the Senate shall, immediately after the passage of this resolution, prepare and file one copy thereof, including the Ballot Title set forth in SECTION 2 hereof, with the Secretary of State and one copy with the Attorney General.
